Thus, the proportionality of this measure could be challenged. As proportionality represents a human rights guarantee in the collection of evidence by covert measures, its different evaluation by the courts of different member states might lead to the inadmissibility of evidence obtained in other member states. As a result, we get back to the issue of human rights, which covers the field of evidence law as an umbrella.
